Quickcharge Privacy Policy

This document sets forth the Privacy Policy of MM Hayes in collecting, storing, and processing Personal Data received by MM Hayes. For purposes of this Privacy Policy, “Personal Data” shall mean any information provided to MM Hayes that relates to an identified or identifiable individual.

Unless otherwise stated in this Privacy Policy, this policy shall be deemed to apply to M.M. Hayes Co., Inc., and our affiliates, and all references to “we,” “us,” and/or “our” shall refer to M.M. Hayes Co., Inc., and those affiliates.

1) Personal Data Collected

MM Hayes collects, processes, and/or stores your Personal Data from a number of sources to provide products and services under our contracts with our Customers and to improve those products and services.

Sometimes we collect data, such as name, company name, IP address, and email or physical address, directly from you when you provide contact and other information to us through an MM Hayes website or mobile application (a “Site”), or when you use certain services. By voluntarily providing us with Personal Data, you consent to our use of that information in accordance with this Privacy Policy. If you provide Personal Data to us electronically, you acknowledge and agree that such Personal Data may be used in order to provide our services to you or your employer and its affiliates, consistent with applicable law.

MM Hayes may record how you use our products, including what you purchase, how frequently you purchase items, and the amounts of purchases.  MM Hayes may also receive your Personal Data from others in order to deliver our cashless payment and point of sale products and services. Such information may include name, employee number, and other identification information.

We also may collect and/or log specific visitor information, which may include both non-identifiable information and Personal Data, including browser, operating system, IP address, cookie information, time stamp, and clickstream information. This data may be collected through the use of log files, “cookies,” “web beacons,” or other similar technologies. We may collect and store this information and combine it with other Personal Data you have provided.

2) How MM Hayes Uses Personal Data

We use Personal Data in a manner that is consistent with this Privacy Policy in order to provide the services. MM Hayes does not sell or provide Personal Data to advertisers or other parties not involved in the provision of the services.

Where applicable MM Hayes may collect and process your Personal Data in accordance with its Customer’s or your employer’s instructions. MM Hayes will only use that Personal Data to provide products and services consistent with those instructions and this Policy.

3) Our Disclosure of Your Personal Data

MM Hayes may share or distribute your Personal Data (i) in order to provide our services, (ii) to maintain the security of our products, (iii) as permitted by contract between MM Hayes and our Customer, or (iv) as otherwise provided in this Policy.

MM Hayes contracts with other companies to perform certain business-related functions. Examples include cloud hosting and/or maintaining databases and processing payments. When we employ another party to perform a service or function, we may need to provide them with access to certain Personal Data. In that event, we only provide them with the information that they need to perform their specific service or function.

We also may disclose your Personal Data to (i) comply with a legal obligation, (ii) protect and defend our rights or property, (iii) act in urgent circumstances to protect the personal safety of users of a Site or the public, or (iv) protect against legal liability.

4) Children Under the Age of 13

With limited exceptions, MM Hayes websites are not intended for children under the age of 13. No one under that age may provide any information through the services without parental consent. Consistent with the federal Children’s Online Privacy Protection Act of 1998 (COPPA), we will never knowingly request personally identifiable information from anyone under the age of 13 without requiring parental consent. Any person who provides their personal information through the services represents that he or she is 13 years of age or older.

If you are under the age of 13, do not register for, use, or provide any information through the websites without parental consent. If we learn that we have collected or received personal information from a child under the age of 13 without verification of parental consent, we will delete that information. If you believe that we might have any information from or about a child under the age of 13 without parental consent, please contact us.

5) External Payment Processing

MM Hayes contracts with or integrates its services with other companies for payment processing, and the payment information you submit is collected and used by them in accordance with their privacy policies. MM Hayes receives from such companies limited payment information from transactions including partial credit card information.

MM Hayes is not responsible for the privacy policies and procedures of such companies and the privacy policies and procedures we describe here do not apply to external sites. We recommend that you read and understand the privacy policies of all external sites.

6) Security

We utilize commercially reasonable physical, technical, and administrative controls and procedures to safeguard the Personal Data provided to MM Hayes and protect it from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Users of our Sites and online services are responsible for maintaining the security of their passwords, user IDs, or other authentication methods.

7) Retention of information

We will retain your Personal Data as needed to provide services to you or your employer and to meet legal requirements, including record retention, resolving disputes, and enforcing our agreement.

8) Request for Personal Data

Upon written request, MM Hayes will (i) provide your specific pieces of Personal Data and related categories that we have collected, or (ii) delete any personal data that we have collected. If you make a request, MM Hayes will respond within 30 days of receipt of request.

9) Changes to Our Privacy Policy

At times it may be necessary for us to make changes to this Privacy Policy. Accordingly, we reserve the right to update or modify this Privacy Policy at any time and from time to time without prior notice. Please review this policy periodically, and especially before you provide any Personal Data to us. Your continued disclosure of Personal Data to us after any changes or revisions to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy.
